PRIVACY POLICY

When you use our websites and services, you trust us with your information. We are committed to keeping that trust. That starts with helping you understand our privacy practices.

When this policy mentions “Perth Yoga for Everybody,” “PYFE,” “we,” “us,” or “our,” it refers to One Race Pty. Ltd. The community group that is responsible for your information under this Privacy Policy (the “Data Controller”).

This Privacy Policy explains how we collect, use, process, and disclose your information. This policy applies to all users of the the following websites, anywhere in the world (referred to here-in-after as “Websites”):

 

and specifically applies to:

  • Participants: users that purchase tickets or reserve spots at our yoga events

  • Consumers: users that buy products or private contracted services from us

  • Browsing Users: users who browse our Websites.

This policy also applies to those who provide information to PYFE in connection with an application to use our services, or whose information PYFE otherwise receives in connection with its services. All those subject to this policy are referred to as “users” for purposes of this policy. We do not process personal information outside of Australia.

By using our Websites you consent to the effective Privacy Policy and Terms of Use published on our Websites at the time of you using them. By attending our events you consent to the Privacy Policy in effect on our Websites at the time of reserving your spot and have read, signed and submitted our Liability Waiver and Registration Form, required by all members, prior to the first time they attend class after the 1st April 2019.

1. INFORMATION WE COLLECT

We collect information from you when you register on our Websites, attend our yoga classes, subscribe to our newsletter, attend an associates or client’s yoga event, respond to a survey, fill out a form or register in person.

When registering as a student in class or on our Websites, as appropriate, you may be asked to enter your: name, e-mail address, mailing address, phone number, date of birth or information relating to your current financial hardship in-order to claim concession. You may, however, visit our Websites anonymously. You may also provide information to us relating to your physical health and medical conditions or other sensitive information, that is personal to you via our Forms and by direct, secured communication channels rather than through 3rd party platforms like our Meetup, Facebook or Instagram pages.

We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). We do not collect any information from anyone under 16 years of age without the written permission of the child’s parent or guardian. Our Websites, products and services are all directed to people who are at least 16 years old or older. Where a participant is under the age of 16 years old, the child’s parent or guardian must engage PYFE on the child’s behalf. We do not send marketing information or communications of any sort to children under 16 years old.

There are three general categories of information we collect.

1.1 Information you give us.

 

The following information is collected by or on behalf of PYFE when you use the Websites.

  • Contact Information and Signature. We require certain information such as your name, email address, address, your date of birth and phone number and signature when you booking a spot at an event or purchasing a service from us, via our Websites. You may, however, visit some of our Websites anonymously, without providing any information. We do not collect information that others provide about you when they use the Websites. We may obtain information from other sources and combine that with information we collect through the Websites, as necessary

  • Concession identity cards and other information submitted via forms. When you apply to PYFE to pay by a donation amount via the Websites, we determine eligibility for the scheme by asking you to upload or take a picture of your concessionary identification card to an application form. This information may be used to determine the validity of your application and the expiry of the approved concessionary period.

  • Communications data. When you communicate with PYFE customer support or use the Websites to communicate with us, we collect information about your communication and any information you choose to provide.

  • Payment Information. We collect your financial information (like your bank account or credit card information) if you need to process a payment with us. We do not store your payment information. This is processed securely by the 3rd party payment processing services we use, that are in compliance with the relevant financial services legislation and compliance procedures.

  • Health Related Information. You may provide information to us relating to your physical health and medical conditions and other sensitive information to help us best facilitate your safety and comfort. We encourage open communication via our email or website ‘www.perthyoga.org’ between participants and their teachers about injuries, illnesses or any special circumstances that the teacher ought to know about to best accommodate participants at our events. We do not encourage the use of our other web pages that comprise the Websites to communicate such information as the risks of safeguarding this sensitive information can not be adequately minimized unless you contact PYFE securely via www.perthyoga.org. This information may be collected prior to or when attending one of our events. The information that you share with PYFE and its teachers, will be recorded and safeguarded in accordance with this policy. We do not publish any of the above user data publically on the Websites.

  • Information about minors you register with and guardians you nominate. All attendees under 18 years old must have a parent or legal guardian sign a Liability Waiver and Registration Form to consent to our terms on the child’s behalf. The information you give us about your child is limited to the minor’s name and date of birth to identify them. We do not send communications to minors, but to the guardian that submits the sign up form on their behalf.

  • Profile Information. When you create a participant profile on our Websites, you have the option to upload your photo to make it easier for our teachers to identify you at an event or online, to personalise your experience and to better respond to your individual needs.

  • Other Information. You may choose to provide us information when you fill in a form, apply for a concession, conduct a search, update or add information to our Websites, respond to surveys, post to community forums, answer questions to join our Meetup Group, update your user profile, participate in promotions, participate in events where your picture may be taken or use other features or services of the Websites.

  • Teachers and Contractor Information. Our teachers may use our Websites to interact with other users, post content and have statistics recorded about the number of transactions they enter into and facilitate for PYFE. This may include collecting information about Teacher’s work availability and whether the Teacher accepts and completes jobs when events and services are delivered and requested through the Websites. We also require information and evidence from the Teachers we contract, including Substitute Teachers that intend to cover a class. We do this to ensure that our Teachers meet the minimum qualification, insurance and experience requirements to teach yoga and deliver the relevant services we provide. This information may include copies of certificates, evidence of training qualifications, insurance policies and pictures of membership ID cards and registrations, such as a Working With Children’s Card.

 

1.2 Information we automatically collect from your use of the Websites.

 

When you use the Websites, we collect information about the services you use and how you use them.

  • Usage Information. We collect information about your interactions with the Websites, such as the pages or other content you view, and other actions on the Websites.

  • Cookies and Similar Technologies. We use cookies and other similar technologies, such as web beacons, pixels and similar technologies that create and maintain unique identifiers. Cookies are small files that a site or its service provider transfers to your computers hard drive through your Web browser (if you allow) that enables the sites or service providers systems to recognise your browser and capture and remember certain information. We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits and compile aggregate data about our Websites’ traffic and interaction so that we can offer better site experiences and tools in the future. If you prefer, you can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies via your browser settings. Like most websites, if you turn your cookies off, some of our services may not function properly. However, you can still place orders over the telephone, in person or by contacting customer service.

  • Log Data. We automatically collect log information when you use the Websites. That information includes, among other things: details about how you’ve used the Websites (including links to third party applications), IP address, access times, hardware and software information, device information, device event information (e.g. crashes, browser type), and the page you’ve viewed or engaged with before or after using the Websites.

  • Transaction Information. We collect information related to your transactions on the Websites, or when receiving a payment from you including the date and time, amounts charged, and other related transaction details.

  • Communications data. We enable users to communicate with us via Websites, and other services. For example, we may receive an email from you enquiring about attending one of the Yoga classes we run or promote. To provide this service, PYFE receives some information regarding the email, including the date and time of the email and any follow up call/text made. This includes the content of the communications. PYFE may also use this information for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services and for analytics. To mitigate the risk of a breach of your confidential communications, we require all confidential information to be provided by emailing us at info@perthyoga.org and similarly, prefer that communications between us are carried out by direct email or via the aforementioned website only.

  • Health related information and next of kin. If you use our website www.perthyoga.org  to book a ticket at one of our events, you may be automatically asked to disclose any pre-existing or new medical conditions, injuries, illnesses or circumstances that may effect your participation on the date you have booked to attend (including pregnancy). You may also chose to communicate this information in person to the teacher delivering the event and disclosures of this nature are encouraged to mitigate any risks that are outlined in our Liability Waiver and Registration Form. This data is treated as highly confidential and is safeguarded in accordance with this policy. Similarly, participants may be required to complete and sign this Liability Waiver and Registration Form , or any or any other forms that we require you to submit to access concessions or apply to use services or features of our services that further benefit the user over other users. Information you may provide includes, but is not limited to, images of current concession cards held and details of your next of kin or other information, so that participants understand any risks presented by partaking Yoga and event activities and can manage them responsibly.

  • Performance statistics and usage data of teachers. Our teachers may use our Websites to interact with other users, post content and submit statistics to us that they record in our registers about the number of students and classes they deliver for PYFE. Our Websites may also automatically collect information about work availability and the acceptance and completion of jobs when events and services are delivered.

 

1.3 Information we collect at our events.

 

The following information may be collected when you attend our events:

  • Contact Information and Signature. We require certain information such as your name, email address, address, your date of birth and phone number and signature when submitting our Liability Waiver and Registration Form, the first time you attend one of our yoga events.

  • Information about minors you register on behalf of and guardians you nominate. When you attend an event we give you the opportunity to fill in the signup form upon checking in. We encourage open communication between participants and their teachers about injuries, illnesses or any special circumstances that the teacher needs to know about to best accommodate that student safely. This information may be collected when attending one of our events or via the Liability Waiver and Registration Form or any other forms that we require you to submit to access concessions or apply to use services or features of our services that further benefit the user over other users. The information that you share with PYFE and its teachers, will be recorded and safeguarded in accordance with this policy, so that we can better accommodate your safety and better personalise each users experience at events.

  • Surveys, opinions and petitions. As a community group, we may gauge your opinion on ideas and action that could further increase the wellbeing of others in our community. Your participation is voluntary and helps us better serve you by understanding what you enjoy and want.

  • Photos, Videos & Sound Recordings (PVSRs) and promotional uses of images. Photos may be taken at our events if PYFE (or our affiliate) has stated, at the end of the description of the event listing on the Websites, that “Photos may be taken at this event, for promotional purposes”. We believe our users should have the choice in relation to consenting to have tasteful group photos taken to inspire others to partake in our classes. Where PVSRs are permitted to be taken, participants consent to the exclusive use and ownership of these PSVRs and a waiver of all rights associated with the recordings in accordance occurs upon agreeing to this Privacy Policy and the Liability Waiver and Registration Form, that is required to be submitted before the first time you attend.

 

1.4 Information we collect from third parties.

 

Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off the Websites through partnerships, or about your experiences and interactions from our partner and networks. This may include users or others providing information in connection with claims or disputes.

 

Other sources of information may include:

                 

  • Users requesting services for or on your behalf.

  • Publicly available sources.

  • Marketing service providers

 

2. HOW WE USE INFORMATION WE COLLECT

 

We use, store, and process information about you to provide, understand, improve, and develop the Websites and sales facilitated by them. We use this data to create and maintain a trusted and safer environment for these business activities to take place.

2.1 Provide, improve, and develop the Websites and services.

This includes using the information to:

  • Enable you to submit communications to us via email or direct message through our Websites.

  • Verify your identify as the person or organisation you are acting on behalf of.

  • Reserve your booking and have your booking status communicated to the event teacher so that you can be checked-in on arrival.

  • Measure and evaluate the amount of users that benefit from our financial hardship program and other social outcomes we strive towards.

  • Operate, protect, improve and optimise the Websites and event experience, such as by performing analytics and conducting research.

  • Perform internal operations necessary to provide our services, including to troubleshoot software bugs and operational problems, to conduct data analysis, testing, and research, and to monitor and analyse usage and activity trends.

 

2.2 Create and maintain a trusted and safer environment.

 

We use your data to help maintain the safety, security and integrity of our services and users. This includes, for example to:

  • Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.

  • Conduct investigations and risk assessments.

  • Verify or authenticate information or identifications provided by you (such as to verify your identity or qualifications if you are a teacher applying to deliver yoga classes).

  • Comply with our legal obligations.

  • Resolve any disputes with any of our users and enforce our agreements with third parties.

  • Enforce our Terms of Use, and other policies and procedures.

 

2.3 Communications from PYFE.

 

PYFE uses the information it collects for purposes including to:

  • Provide you information about purchases you can make from us.

  • Send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your communication preferences (including information about PYFE or partner campaigns and services).

  • Personalise, measure, and improve advertising.

  • Administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by PYFE or its third party business partners.

 

You can unsubscribe or opt-out from receiving emails and other messages from our Websites by following the instructions in those messages. Please note that if you opt out, we may still send you non-promotional messages, such as receipts for your purchases or information you have requested.

 

2.4 Customer support.

 

We may use the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services, including to:

  • Direct your questions to the appropriate customer support person

  • Investigate and address your concerns

  • Monitor and improve our customer support responses

 

2.5 Research and development.

 

We may use the information we collect for testing, research, analysis and product development. This allows us to improve and enhance the safety and security of our services, develop new features, products, community initiatives and unique event experiences.

 

 

3. SHARING & DISCLOSURE

 

3.1 With Your Consent.

 

We may share your information at your direction or as described at the time of sharing, such as when you authorise a third party application to share one of our Websites to your social media pages. If you use a share option to share any of our Websites using a third party service (e.g., Facebook, WeChat), the third party service may send us information such as your registration and profile information from that service. This information varies and is controlled by that service or as authorised by you via your privacy settings at that service.

Any possibility of pictures, video or recordings being taken at our events will be disclosed in accordance with this policy.

 

3.2 Sharing between other users.

 

The Websites facilitates direct communication between PYFE and Website users. We may also provide you with the option to share our Website with external persons or organisations. This is at your own discretion and

we do not share any of your information with other users.

 

3.3 Profiles, Listings, and other Public Information.

 

The Websites may allow you to publish information that is visible to the general public. This may include, your first name, pictures of you, the city where you live and other personal data that you chose to provide. This information is used to identify you and understand your preferences, to better process and service your needs during your interactions with us via our business activities.

 

3.4 Service Providers.

 

We use a variety of third party service providers to help us provide services related to the Websites. Service providers may be located inside or outside of the European Economic Area (“EEA”). For example, service providers may help us: (i) verify or authenticate your identification, (ii) check information against public databases, (iii) assist us with background checks, fraud prevention, and risk assessment, or (iv) provide customer service, advertising, accounting or payments services.

This may include, for example:

  • Payment processors and facilitators.

  • Background check providers (yoga teachers, organisers and contractors only).

  • Cloud storage and dedicated server providers.

  • Email providers

  • Marketing partners and marketplace platforms

  • Data analytics providers.

  • Research partners, including those performing surveys or research projects in partnership with PYFE or on PYFE’s behalf.

  • Vendors that assist us to enhance the safety and security of its Websites.

  • Consultants, lawyers, accountants and other professional service providers.

  • Online forms and contract providers

  • Website and App development service providers

  • Online Accounting solution providers

 

These providers have limited access to your information to perform these tasks on our behalf, and are obligated to use it consistently with International Privacy Law, in the jurisdiction in which they operate.

 

3.5 Safety and Compliance with Law.

 

We may disclose your information to health professionals in the unlikely occurrence that you require medical attention and you, us or your next of kin engage emergency services or local authorities on your behalf, whilst participating at any of our events.

 

We may also disclose your information to courts, law enforcement or governmental authorities, or authorised third parties, if and to the extent we are required to do so by law or if such disclosure is reasonably necessary: (i) to comply with legal process and to respond to claims asserted against PYFE, (ii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability, (iii) to enforce and administer our Terms of Use, Policies and Procedure or other agreements with users, (iv) for fraud investigation and prevention, risk assessment, customer support, product development and debugging purposes, or (v) to protect the rights, property or personal safety of PYFE, its employees, its users, or users of the public.

We will attempt to notify users about these requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon PYFE’s property, its users and the Websites (collectively, “Risk Scenarios”). In instances where we comply with legal requests without notice for these reasons, we will attempt to notify that user about the request after the fact if we determine in good faith that we are no longer legally prohibited from doing so and that no Risk Scenarios apply.

3.6 Tax and Regulating Authorities.

 

PYFE is an Australian Company that, from time to time uses pages such as the Websites to facilitate business transactions with you as participants, contractors or consumers. We reserve the right to advise the Australian Tax Authority, and any other relevant authorities, about the details of any transactions between us and users of our Websites. This includes taking any actions to effect a purchase made by you from us.

If you receive a payment from PYFE as an Independent Contractor, the Australian Tax Authority may be advised of details about the transaction and your identifying information to ensure that we comply with relevant tax and state legislation.

 

3.7 Business transfers.

 

If PYFE undertakes or is involved in any merger, acquisition, reorganisation, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information. In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

3.8 Aggregated data.

 

We may also share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and non-personally identifiable information for industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

 

4. OTHER IMPORTANT INFORMATION

 

4.1 Information retention and deletion

We require user profile information in order to provide our services, and retain such information for as long as we maintain our business activities.

 

We retain certain information, including transaction information for a minimum of 7 years in connection with regulatory, tax, insurance and other requirements in the places in which we operate. Once such information is no longer necessary to provide our services, enable customer support, enhance the user experience or other operational purposes, we take steps to prevent access to or use of such information for any purpose other than compliance with these requirements or for purposes of safety, security and fraud prevention and detection.

 

You may request deletion of your data in accordance with your rights to do so, as outlined in section 6. Following receipt of such request, we delete the information we are not required to retain. In certain circumstances, we may be unable to delete your profile information, such as if there is an outstanding credit on your account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, we will delete your profile information as described above. We may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if we encounter a user demonstrating unsafe behavior or security incidents, we may retain certain information about that account to prevent that user from engaging our services or Websites in the future.

5. THIRD PARTY PARTNERS & INTEGRATIONS

 

The Websites may contain links to third party websites or services, such as third party integrations, co-branded services, or third party-branded services (“Third Party Partners”). PYFE doesn’t own or control these Third Party Partners and when you interact with them, you may be providing information directly to the Third Party Partner, PYFE, or both. These Third Party Partners will have their own rules about the collection, use, and disclosure of information. This includes Social Technology Limited, trading as Yoga Request (“Yoga Request”), who assists PYFE with the booking, accounting, scheduling and marketing of our yoga and wellness events, and is authorised to, and may send periodic emails to you on our behalf or because it may be related to current, past or future events that you have shown interest in, or may be interested in. We encourage you to review the privacy policies of the other websites you visit. This also includes when users share our Websites via a Third Party Partner (such as Facebook or Instagram).

Note: If at any time you would like to unsubscribe from receiving future emails from us or Yoga Request, detailed unsubscribe instructions are included at the bottom of each email.

6. YOUR DATA CHOICES

6.1 Access and update.

 

You may review, update, or delete the information that we hold on you by emailing us at data@perthyoga.org. We only collect and use the information as outlined in this Privacy Policy. No account user profile is created when using our Websites.

 

6.2 EU and Japan Residents: Review and update your information.

 

If you reside in the EU or Japan, you may request in writing copies of your personal information held by us. We will provide you with a copy of the personal information held by us as soon as practicable, and in any event not more than 40 days after receiving a valid request in writing. There may be a charge to access your personal data (which will not exceed €6.35 in Ireland and £10 in the United Kingdom, and will not be applicable in Japan). We may request proof of identification to verify your access request.

 

If your personal information that we hold is inaccurate, let us know and we will update the relevant information. You may also request the erasure of your personal information in accordance with the relevant data protection legislation. We will notify you within 40 days of your valid request about the relevant action taken.

6.3 EU Residents: Access and challenge information provided to us by third parties.

 

You are entitled to see and challenge information third parties provide to us as part of our fraud detection, prevention and risk assessment efforts if all of the following factors apply: (i) we use third parties to carry out automated checks or risk assessments, (ii) we make a decision which has legal consequences for you or which significantly affects you, and (iii) such decision is based solely on such automated checks or risk assessments.

6.4 Explanations, copies and correction

 

You may request that we:

 

  • Provide a detailed explanation regarding the information we have collected about you and how we use that information.

  • Receive a copy of the information we have collected about you.

  • Request correction of any inaccurate information that we have about you.

 

If you are a PYFE user in the EU, you have the following rights with respect to our handling of your personal information. Users outside the EU may also request explanation, correction, deletion or copies of their personal data here or by emailing data@perthyoga.org.

 

7. SECURITY

 

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorised access, loss, destruction, or alteration. However, the Internet is not a 100% secure environment so we can’t guarantee the security of the transmission or storage of your information.

7.1 How do we protect your information?

We implement a variety of security measures to maintain the safety of your personal information when you register and attend our class or enter, submit, or access your personal information as outlined in this policy. We offer the use of a secure server for any payments made through our Websites. All supplied sensitive/credit card and financial information is transmitted via Secure Socket Layer (SSL) technology and then encrypted at 256 bits, into our Payment gateway provider’s database, only to be accessible by those authorised with special access rights to such systems. Our consolidated database and the forms that collect your information also have a 256 bit encyption, accessable only by PYFE officers. Only information relevant to the roles of PYFEs staff and agents is shared with those staff or agents.Those officers of PYFE, are required to keep the information confidential in accordance with this Privacy Policy and Federal Laws. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will be kept on file for more than 60 days in order to be available for you.

Alternatively, you may choose to use a third party payment processor, (such as Paypal or Stripe) to manage the processing of a transaction with us and your financial information that is required to be shared in order to do so.

We use encrypted messaging systems, virtual private network software and a variety of security measures and software on the devices we operate from, to facilitate our interaction and business transactions with you in accordance with this policy. We actively ensure that our staff and service support team do not click unknown links, or give away any identifying information about our group or our members, involuntarily, when using the devices used to input and process data handled by us. We no longer use Facebook Messenger, WhatsApp or any 3rd Party messenger service to communicate or request confidential information. All users are directed to communicate with us via the Websites and by email.

8. CHANGES TO THIS PRIVACY POLICY

PYFE reserves the right to modify this Privacy Policy at any time in accordance with this provision. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on the Websites and update the “Last Updated” date at the top of this Privacy Policy.
